Definitions

In these terms and conditions, the 'Company' or 'Wine Monopole' means Wine Monopole Limited and 'Customer' means any person, firm, company, corporation or body which places an order with the Company.

Sales
All orders are not binding until the Customer receives our final written confirmation. No cancellations will be accepted after the Company issues the order confirmation which shall be at the Company’s sole discretion and stock availability. Unless stated otherwise, all goods are offered lying in Hong Kong.

Legal Age
By placing an order, the Customer confirms and represents that he/she is 18 years old or over, and he/she is above the drinking age legally allowed in his/her own country of residence. The Customer hereby indemnifies and holds the Company harmless from any claims arising from any inaccuracy of the foregoing representation.

Order Processing
The Company reserves the right to reject the order in the event that any of the goods requested are unavailable. In the event that the Company is unable to fulfill any of the goods in your order, the Company will notify the Customer by phone or email before the requested delivery date. The Company reserves the right to offer alternative goods to the Customer of similar value and style or the Customer shall be entitled to cancel the affected portion of the order.

Goods and Pricing Information
The Company shall make every reasonable effort to ensure goods displayed on the website are in stock and that prices and details of the goods are up to date. Prices are subject to change without prior notice. The final price shall be as stated in the order confirmation.

Wine Conditions
Ullages of all wines offered are top shoulder or better, unless otherwise stated. Although we strive to find wines in their best condition, the Customer must make appropriate allowances for natural variations of ullages, conditions of cases, labels, foils and corks for old wines. We do not accept return wines for any reason, including “corked” wines.

Payment
Payment is due within 7 days upon issue of order confirmation. Otherwise, the order will be deemed cancelled.
Method of payment is accepted in the form of Hong Kong Dollar bank transfer.

No cheques, credit or debit cards are currently accepted.
Please allow 3 working days for payment to clear before goods may be released.

Delivery
Goods can be delivered to most addresses in within Hong Kong. Shipping charges apply to all deliveries, except stated otherwise. For our latest standard shipping policy, please refer to the “Shipping” section on our website.

Breakages/Shortfall
Customers are requested to examine the goods immediately upon delivery or collection for any deficiencies and/or damages. Claims (if any) must be logged at the time of delivery. Any claim submitted thereafter shall be deemed null and void.

Storage
Wine Monopole offers free storage (up to two months; “Free Storage Period”) for Customers who wish to aggregate his/her orders to enjoy free shipping promotions (if applicable). After the Free Storage Period, storage fees are then charged at $10 per bottle per month.  Storage fee must be fully settled prior to delivery of the wines. The Company reserves to change the Free Storage Period and the storage fee rates without advance notice.

Force Majeure
The Company shall not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.

Refund and Return
The Company will not accept any return of goods nor will provide any refund for any orders.

Law and Jurisdiction
All transactions contemplated with our Company shall be interpreted, enforced, and governed according to the substantive laws of Hong Kong SAR, and both parties irrevocably submit to the jurisdiction of the courts of Hong Kong SAR for any action or proceeding regarding transactions contemplated with our Company. If any term or provision of these Terms and Conditions is invalid, illegal or unenforceable in any jurisdiction, such unenforceability shall not affect any other provision.

Entire Agreement
These Terms and Conditions constitute the entire agreement of between you and Wine Monopole regarding the specific matters herein, and all prior agreements, letters, proposals, discussions and other documents regarding the matters herein are superseded and merged into these Terms and Conditions. If there is a conflict, these Terms and Conditions will control.
